Please read these Terms of Use (“Terms”, “Terms of Use”) carefully before using the http://www.labellegray.com website (the “Service”) operated by LaBelleGray (“us”, “we”, or “our”).

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

Terms and Conditions:

In terms of payment this is via PayPal or contact us directly at info@labellegray.com.

If you are using a credit or debit card you must confirm that the card belongs to you.  All card holders are subject to validation checks and authorization by the card issuer.  If, for any reason, the issuer of your payment card does not authorize or refuses payment to us we will not be liable for any delay or non-delivery.

Please be aware that every item is Antique, Vintage or Retro and therefore there is wear and tear, consistent with age.  We take great care to ensure the detail will be set out in photographs and the narrative as best as possible and we are happy to provide further information or photographs if required.   All measurements and sizes are approximate and we make every effort to ensure our photographs and narrative are accurate and consistent with the actual item.

As the majority of our items are unique it may be that certain items on the website may no longer be available and we reserve the right to withdraw any items from sale at any time even if an order has been placed.

Delivery

The charges for posting and packaging will be determined at the time of your order.   We use Royal Mail in the UK and can use other delivery couriers which will be agreed with you at the time of your order.  The prices range, depending upon the size and weight and so please email us so we can provide you with an estimate of cost.

For Europe and International orders we will use couriers such as UPS and DPD and the price will be determined once you have placed your order.  Please note that it is the Buyer’s responsibility for any customs or import tax costs that may apply.

We will endeavour to process your order within 3 working days.  This is conditional upon your order being accepted and payment being received and authorized (unless we are out of the country).  We will confirm an estimated delivery date and this will typically be within 5-14 working days. Most items will be with you within a few days however, should you require an item sooner please contact us.  We cannot accept responsibility for any courier delays and please be aware that around the Christmas and New Year period deliveries could take longer to arrive.

For larger goods, we can arrange for you to collect directly and/or contact us to arrange a mutually convenient time for an appointed courier to deliver the items, once your order has been accepted and payment has been received and authorised.

Once a courier has been arranged, it will be the responsibility of the Card Holder to be available to receive the delivery at the confirmed address and to sign for it on arrival.  Please note that if the Buyer is not present for the delivery of the package, it will be returned and you will be charged for any additional costs incurred.  Please be aware that some orders may take longer to deliver and we will keep you informed of any unforeseen delays.

When your delivery arrives it is your responsibility to check that no damage has occurred within transit.  When the goods are delivered, please ensure there is somebody available to check the items thoroughly.  This will require the removal of all the packaging to ensure there is no damage.

Please only sign for the delivery once you have inspected the item and it is in good condition.  If, once you have checked the item and damage is found please sign the form and return the item to the courier stating that the item/s is or are damaged.  You will need to take photographic evidence and the courier will take the item/s away.  We are only able to claim the cost of damage once this procedure is followed.

Cancellation

If you wish to cancel an order, please contact us within 6 hours of your purchase to ensure the goods have not been dispatched. If,  after this time, your goods have been dispatched it will not be possible to cancel the order.

Accepting Your Order

Your order will be accepted upon the authorization of your payment and availability of the goods, however, we reserve the right to reject any offer to purchase if there are any issues arising around payment.

We have the right to withdraw any products from our website at any time or to edit or remove any items or content on this website.

We reserve the right to refuse to process any transaction for any reasons at any time at our discretion.  We are not liable to any one or any third party by reason of our withdrawing an item from our website.

For anyone to be eligible to make a purchase from our website and lawfully enter contracts on this website you will need to:

  • Be over 18 years old
  • Provide your true name, address, telephone number, e-mail address, payment details and any other pertinent information
  • Have a valid PayPal account and/or credit/debit card that is issued by a bank that is acceptable to us
  • Provide a delivery address in the UK that is not a hotel or PO Box number
  • Once you have made an offer to buy an item you give authorization to us to allow us to obtain information about you from third parties which could include credit or debit card numbers or credit reports in order for us to authenticate your identity and validate your PayPal account or credit/debit card so we can get authorization for any purchase transaction.

Returns

We want you to be delighted with your purchase from La Belle Gray however if, for any reason, you not satisfied with your item/s then we will accept returns.  You will need to email us at info@labellegray.com within 3 days of receiving your item and will need to return this to us within 14 days of receiving the delivery in original condition in order to receive a full refund.  We are unable to refund delivery charges and it will be your responsibility for the cost of returning any item to us ensuring it is in its original condition.  If an item is returned damaged or altered we will not be able to provide a refund.

We are not liable for any business losses.  We are only responsible for the supply of products for domestic and private use.  If you choose to use the products for any commercial, re-sale or business purpose, we will have no liability to you for any loss of profit, business opportunity, loss of business or business interruption.

Intellectual Property

The Service and its original content, features and functionality are and will remain the exclusive property of LaBelleGray and its licensors.

Links To Other Web Sites

Our Service may contain links to third-party web sites or services that are not owned or controlled by LaBelleGray.

LaBelleGray has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that LaBelleGray shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.

We strongly advise you to read the terms and conditions and privacy policies of any third-party web sites or services that you visit.

Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an “AS IS” and “AS AVAILABLE” basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

Governing Law

These Terms shall be governed and construed in accordance with the laws of United Kingdom without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
